Overview
If someone crashes into you while they are over the legal alcohol limit and they are at fault for the accident, you will still be protected as the innocent party.
What to Do at the Scene?
- Call the Police (112) – A police report is required for such insurance claims.
- Do Not Confront the Other Driver – Stay calm and let the authorities handle it.
-
Get Witness Details – Their statements may support your claim.
Will I Be Covered?
- Yes. Maltese law ensures that innocent parties are covered, even if the at-fault driver was intoxicated.
- Your damages and injuries will be covered by the other driver’s insurer.
-
If the driver’s insurance refuses to pay, Malta’s Protection & Compensation Fund may step in to protect you.
How to Make a Claim
- File a police report at the accident scene. Insist that all relevant facts are mentioned by the officer writing the report.
- Contact Laferla’s claims team as soon as possible.
- Provide all required documents (police report, photos, witness details).
Common Misconception
Some believe that if the at-fault driver was drunk, their insurance won’t pay out. This is false as insurers must still cover innocent third-party claims by law. However, they may later recover the costs from the drunk driver. At Laferla, we were quite concerned to read a Times of Malta article in August 2022, which highlighted some misinformation from local authorities in situations of drunk drivers involved in an accident. If you ever encounter this situation, please insist with the authorities drafting the report to mention all relevant facts about the incident.
